The Connotation, Obstacle and Outlet of the Separation of Three Rights of Rural Residential Land

美国概况Abstract: The central government propos to explore the "paration of three rights" of rural residential land, and takes the "paration of three rights" of rural residential land as a major theoretical and practical issue that needs to be studied. The paper considers that the qualification right of rural residential land should be an identity claim subordinate to the membership right of collective economic organizations, and it cannot be registered in real estate. The division of the right to u the rural residential land into the design of including qualification right and not including qualification right goes against the legal provisions and basic legal principles, also increas the cognition and implementation costs of the system. It is also related to the inconsistent approach and the slow progress in the various pilot areas. According to the provisions of Chine Civil Code, it is not necessary to stick to the original textual reprentation. From the perspective of "ownership, u right, lea right" and "ownership, u right and residence right", we can explore the new idea of "Separation of Three Rights" of rural residential land, in order to make the u right of rural residential land and peasants' right to u hous more flexible.
