海事声明(Sea protests)
1、船舶若在航行或停泊中遭遇自然灾害或其他意外事故,已造成或估计造成船货损坏时,则船长应在船舶到达第一中途港或目的港卸货前,向当地港口机关或使领馆提交海事声明。特别强调的是,如果由于船舶的损坏可能会导致货损,如货油舱进水等等,船长也应该提交海事声明。提交海事声明是国际航运实践中的一项惯例,是船东向货主就货损要求免责、宣布和向货主要求分担共同海损、向保险公司提出保险赔偿以及有关部门就整个海损事故的调查,判明责任的依据等。
2、港口当局或使领馆在收到船长的海事声明后,经过检查、询问在并海事声明上签注或盖印,经过签证的海事声明的法律效力取决于各国的法律规定及法院的态度。船长应注意航海日志的记录,注意保留航海气象资料,并且准备好证明人的材料。

In view of the follow:
My ship encountered very heavy weather in the English Channel and the Bay of Biscayen route from Rotterdam to Dakar on 6th-7th Jan 1990 with southwesterly winds of strong gale force 9-10 of Beaufort scale. In this period the ship was pitching, rolling and labouring violently, and shipping as over forecastle, deck and hatch cover continuously.
Although decreasing speed was adopted in order to reduce chances to be attacked by very rough as, the vesl was still manoeuvring with great difficulties. The crew and I had applied all possible means of safeguarding the vesl and cargo before and during the vesl’s sailing. However, on 7th Jan. it appeared that two pieces of the truck crane (8 tons each) were moving due to lashing wire break and struck the ship’s hull violently. Conquently, I was compelled to alter the ship’s cour backward to the port of Rotterdam for further arrangement. Fearing loss or damage, I hereby note my protest against all loss, damages, etc., rerving my right to extend same at time and place convenient.
