Factors that determine the non-immigrant status for which I should apply?
The following factors may have bearing on a foreign national’s eligibility for immigration status: •nature and duration of the initial appointment;
•amount of time available before the individual is to take up the position;
•individual's U.S. immigration history;
•long-term plans of the College and the individual (Is the nature of the employment likely to change?
Will the candidate wish to remain in the country?);
•possibilities of employment for the spou;
•tax implications;
•international travel plans
How long does it take to come to the U.S. to work or to change to a work-authorized immigration status?
Most foreign nationals coming to the College as faculty or as administrative professionals will qualify for H-1B status. This is a non-immigrant classification available to temporary professional workers. A person may be in H-1B status for up to six years, although this period of admission can be extended under some limited circumstances. This is an employer-sponsored status that requires the filing of a Petition with the U.S. Citizenship and Immigration Service (“UCIS”, formerly “INS”). The Petition is fil
ed with a regional processing center and is adjudicated without any personal appearance by the foreign national or by the employer. Once the Petition is adjudicated and the foreign national is found eligible for H-1B status, the UCIS issues a notice of approval. If the foreign national is in the U.S. in a different valid non-immigrant
status, then the notice of approval will include a change of status, and the foreign national will automatically become an H-1B on the effective date of the Petition. If the foreign national is outside the U.S., then the notice of approval will recognize the foreign national’s eligibility for H-1B status, but will require the issuance of an H-1B visa before the person can come to the U.S. with authorization to work for the College. Assuming that the applicant meets all of the other criteria for J-1 status, the consular officials will issue the J-1 visa and stamp the DS-2019, thereby authorizing the foreign national to come to the U.S.
