Employment Contract
劳动合同
BS Engineering Consulting (Shanghai) Co., Ltd. (hereinafter called Employer) agrees to employ Mr. / Ms. (hereinafter called Employee). This Contract is signed on a mutuality voluntary basis by and between the following Employer and Employee in accordance with the Employment Law of People's Republic of China.
上海博尚建筑工程咨询有限公司(以下简称雇主)现聘用(以下简称雇员)为劳动合同制职工。双方根据中华人民共和国劳动法规定,本着自愿、平等的原则,经协商一致,特签订本合同, 以便共同遵守。
1. Term of the Contract:

The term of this contract is for year and shall commence on , and shall continue until . The Employee shall undergo a probationary period of months.
许淑清合同期限为年,从起,至止。其中试用期为个月。
2. Job Description:
工作描述
The Employer agrees to employ the Employee as being executed by the Employer. The Employee has to fulfill his duty for the Employer and the Client through supplying his knowledge and talent. Job position of the Employee can be not only at the Employer’s headquarters but also on job site where the Employer supplying management rvice.
雇主聘用雇员从事工作。雇员将运用个人的知识和才干为公司及客户尽职。雇员的工作岗位可以在公司本部,也可以在公司提供管理服务的工地现场。
The Employer has the right to adjust Employee’s job according to the requirement of the Employer. 雇主有权根据业务需要及雇员的能力、表现调整雇员的工作。
The Employee has the right to express his own opinion for job adjusting. However the Employee shall obey the arrangement from the Employer if his opinion is not confirmed by the Employer.
雇员有反映本人意见的权利,但未经雇主批准,雇员须服从雇主的管理和安排。
The Employee shall finish the job arranged by the Employer in time with high quality.
雇员应按时、按质、按量完成雇主指派的任务。
3. Working Conditions & Working Protection
工作环境及劳动保护
a. The Employer should provide the Employee with occupational safety and health conditions
conforming to the Chine regulation and necessary articles of labor protection to guarantee the safety and health during the working process.
雇主需为雇员提供符合国家规定的安全卫生的工作环境,保证雇员人身安全、并在人体不受危害的环境条件下从事工作。
b. The Employee should strictly abide by the rules of safe operation in the process of his work.
雇员在工作中应严格遵守安全操作原则。
4. Working Hours & Rest & Vacation
工作时间,休息日及休假
可爱的用英语怎么说a. The normal working hours of the Employee shall be eight hours each day excluding meals and
rest, for an average of five days, that is forty hours per week. However the work time shall be flexible, if the Employee is working on site. When the prence of the Employee is necessary for the site work, the Employee shall fulfill his obligation and no additional remuneration will be compensated.
公司实行每周工作五天,四十小时,每天8小时工作制,不包括午餐及午休。如果雇员在施工现场工作,工作时间可能作灵活调整。根据需要如果雇员必须在现场处理工作,那么他就应该履行其职责,在此情况下对所延长的工作时间将不予以支付额外酬金。
The working time for headquarter office begins generally 9:00 and ends between 17:30-18:00 ( in it a half to one hour for lunch and intermission). However the work time shall be flexible for some type of work.
办公室人员工作时间一般从9:00开始,17:30-18:00 之间结束(其中半到一小时为午餐和午休时间)。部分工种实行不定时工作制。
b. The Employee is entitled to all legal holidays and other paid leaves such as marriage leave,
funeral leave, childbearing leave, etc. in accordance with the laws and regulations of the PRC and the vacations according to the company 's rules.
雇员享有国家规定的法定节假日,婚假,丧假,计划生育假等假日及公司规定的休假日。
c. The Employee is entitled to vacation of 5 working days with full pays per year after one year

working in the company. It will be incread one day vacation every one more year after three year working in the company. The vacation should be ud before end of March next year. It should not be reissued for overdue.
雇员在本公司工作一年后享有每年5 天的有薪休假。雇员在本公司工作三年后,工作每延长一年,增加休假一天。每年的休假使用到第二年的三月底截止,逾期不补。
5. Regulation for Overtime Work
加班制度
The Employee shall try his best to rai work efficiency to finish his work within normal working time. 雇员应努力提高劳动效率,在正常的工作时间内完成本职工作。
In principle the Employer will not arrange overtime work for the Employee except normal working time. If the Employer requests the Employee to work overtime under special condition, the Employee is requested to obey the requirement.
雇主对雇员原则上不在正常工作时间外安排加班,因特殊情况必须加班则要求雇员能服从工作需要。
放胆The overtime work done by the Employee will be compensated by the Employer in form of arranging extra holiday for overtime work, ttling overtime payment or etc.
雇员的加班由雇主安排调休,结算加班工资或以其他方式给予补偿。
Approval and ttlement of overtime work is executed according to Employer’s relevant regulation. 加班的审批和结算按公司相关规定处理。
The overtime work regulation is not applied to managers such as project manager, office manager, work team manager, etc.
对项目经理,办公室负责人,工作团队负责人等不计加班时间。
6. Remuneration
酬金
a. The remuneration of the Employee shall be monthly paid by the Employer.
雇主将按月支付雇员酬金。
b. The remuneration of the Employee parately in the probationary period and after the
游九曲probationary period takes RMB per month, altogether 12 months per year.
在试用期内及试用期后,雇员的酬金都为人民币元/月,一年支付 12个月酬金。
c. The remuneration mentioned above has covered personal income tax and the personal part of
social insurance, medical insurance, hou funds.
上述酬金涵盖了雇员的个人所得税和个人应当支付的社会保险金, 医疗保险金, 公积金。
d. The remuneration is paid by the Employer on 1st of each month for the work of last month.
每月1号支付上月酬金。
e. If the Employee works on site continually more than one month, he can get monthly RMB
as site allowance and RMB as telecommunication and food
allowance. For above mentioned allowances, the Employee shall draw on the payment by form of submitting invoices as the refund attachment.
雇员在工地工作超过一个月,每月可以得到元工地补贴和元通讯及餐费补贴。上述补贴需雇员以发票报销的形式支取。
f. During the Employee working on site, accommodation will be supplied by the Employer free of
charge.
雇员在工地工作期间,住宿由公司免费提供。
7. Wage System
工资制度
希腊攻略Job and grade related wage system is executed by the Employer. The remuneration will be calculated day by day.
雇主实行岗位等级工资制度,并实行按日计薪的办法。
Bonus is the award for the Employee, which is executed by the Employer according to the Employer’s benefit and bonus examination measure. If the Employee quits his job within bonus examination period, he is not entitled to have such award mentioned above.
奖金是雇主根据效益,按奖金考核办法对雇员实施的奖励,如果雇员在奖金考核期内离职则不享受此项待遇。
Wage of female staff within maternity leave period is executed according to the regulation defined in Shanghai Maternity Insurance. Allowance for maternity and living is relead by social insurer. If the maternity allowance is lower than the cardinal number of social insurance, the balance ction will be paid by the Employer.
耳闻目睹女职工产假期间的工资按《上海市城镇生育保险办法》规定执行,由社会保险机构发放生育生活津贴。生育津贴低于社保基数的,差额部分由雇主发放。
Personal disposal income of the Employee shall pay personal income tax in accordance with law. The personal income tax will be deducted and remitted by the Employer.
廉顽立懦雇员的个人收入所得依法缴纳个人收入所得税,并由公司代扣代缴。
Confidentiality regulation for wage is executed by the Employer. The Employee can not disclo or ask about other persons’ wage condition. Any behavior of the Employee breaches this regulation will be punished.
雇主实行薪金保密发放制度,雇员不得透露本人或打听他人薪金情况。任何违背此项规定的行为均将收到处罚。
The Employer will adjust the Employee’s total wage income irregularly according to the Employer’s benefit, personal outstanding achievement of the Employee, social status, etc.
雇主根据效益,个人业绩,社会状况等因素不定期调整雇员的总体工资收入。
