8. DEMURRAGE/NO DESPATCH: CHTRS TO PAY SHIPOWNER USD20,000.00 PER DAY OR PRO-RATA FOR LAYTIME LOST AT L/D PORT,NO DESPATCH. DEM AT LOADING PORT WILL BE SETTLED WITHIN OCEAN FRT,DEM AT DISCHG PORT WILL BE SETTLED W/I 3 DAYS AGAINST RELATIVE DOX AFTER COMPLETING DISCHARGING ,BUT ALWAYS BEFORE RELEASE ALL OF THE CGO.
滞期费/无速遣费:如在装卸港产生的时间损失租家应按每天20000美金支付给船东,不足一天按比例计算。无速遣费。如在装港产生的滞期费和运费一起结算,如在卸港产生的滞期费则租船人在卸货完毕后3个银行工作日内凭相关文件支付给船东,但无论如何须在放货前结算清楚。
DETENTION:
– CHARTERER GUARANTEE THAT CARGO AND THE DOCUMENTS MUST BE READY FOR LOADING BEFORE VESSEL’S ARRIVAL AND COMMENCE LOADING 72 HOURS WITHIN VESSEL ARRIVAL LOADING PORT.IF NOT COMMENCE LOADING WITHIN 72 HOURS OF VESSEL ARRIVAL DUE TO CARGO/DOC NOT READY,CHARTERER SHOULD PAY DETENTION USD20,000 /DAY EVERY 3 DAYS IN ADVANCE .OTHERWISE OWNER HAS RIGHT TO WITHDRAW THE VESSEL WITH NOTICE BY TELEX OR FAX WITH THE DEPOSIT EARNED.IF LAYDAY RUN OUT VESSEL ENTERS DEMURRAGE,CHARTERERS TO PAY OWNERS DEMURRAGE EVERY 3 DAYS OR PRO-RATA,FAILING WHICH,OWNER HAS RIGHT TO WITHDRAW THE VESSEL WITH DEPOSIT EARNED.
在船舶到港前,租家应保证货物和资料已经备妥,并在船舶抵达后的72小时内装货。如果在船舶到达的72个小时以內沒有裝货或由于货物/单证没有备妥,租家應每3天预付20,000美元/天的延滯费,否则船东有权以电传或者传真形式撤船并沒收保证金。如果LAYTIME时间用完,船舶进入滯期,租家应每3天预付滯期费或按比例计算,如果沒有做到,船东有权撤船并沒收定金。
9. FRT PAYMENT: 运费支付
9.1 20% FREIGHT AS DEPOSIT TO BE PAID BY CHRTRS TO ONR’S NOMI ACCT W/I 3 DAYS AFTER SIGNING THIS F/N BY BOTH PARTIES.BALANCE 80% TO BE PAIED BY THE CHARTERER INTO OWNERS NOMINATED ACCT WITHIN 3 DAYS AFTER COMPLETION OF LOADING BUT ALWAYS BBB. ORI BS/L TO BE SIGNED/RELEASED AFTER ONR HV CHRTR’S FULL PAYMENT IN ONR’S NOMI ACCT.
合同签定后3个银行工作日内租家将20%运费做为保证金付到船东指定帐户。剩余80%运费在装货完毕后3个银行工作日内支付到船东指定帐户。船东在收到租船人全额海运费后签
发正本提单给租船人,提单应注明“运费已付”。
9.2 ALL FREIGHT SHALL BE DEEMED EARNED AS CARGO IS LOADED ON BOARD, AND FREIGHT IS DISCOUNTLESS NON-RETURNABLE WHETHER THE VESSEL OR THE CARGO IS LOST OR NOT.
货物装船后全部运费均不能折扣不能返还,无论船舶/货物灭失与否。
