经修订的1978年海员培训、发证和值班国际标准（STCW）公约 2010年马尼拉修正案的适用 -- 转发巴拿马海事主管机关第235期海商通函
巴拿马海事主管机关近期向船东、船舶经营人、公司保安员、巴旗船舶的法定代理人、巴旗商船领事及认可组织下发了海商通函MMC-235，就巴拿马接受经修订的1978年海员培训、发证和值班国际标准（STCW）公约之2010马尼拉修正案的情况做了进一步说明。
1.该修正案已于2012年1月1号生效，是经由2011年11月18号的ADM.No.148-2011决议批准，于2011年12月15号在官方公报No.26932-A上发布。

2.巴拿马海事主管机关已经在决议JD087-2010中明确将按照STCW 2010年马尼拉修正案的规定签发下列证书：
2.1 电子-技术高级船员(规则 III/6)
2.2 电子-技术普通船员(规则 III/7)
2.3 一级水手(规则 II/5)
2.4 一级机工(规则 III/5)
3.国际海事组织（IMO）海上安全委员会在2011年6月11号的第89届会议上审议了一系列需紧急澄清通告STCW.7/Circ.16和STCW.7/Circ.17中关于2010年马尼拉修正案的问题。
最重要的解释说明包括:
3.1 按照2012年1月1日前生效的公约条款所签发证书的再生效，以及对在2013年7月1号之前或之后开始从事经批准的远洋服务、教育和培训项目或培训课程的海员签发证书；包头海洋馆
3.2 和证书签发无关的过渡条款；
3.3 保安相关的培训条款；
3.4 对持有在2012年1月1号前适用公约条款签发的证书，但不符合2010年马尼拉修正案要求的海员来说，任何再生效证书的有效期不应超过2017年1月1号；STCW.7/Circ.17.；
3.5 对持有2012年1月1号前适用公约条款签发的证书，并且符合2010年马尼拉修正案要求的海员来说，任何再生效证书的有效期可以超过2017年1月1号；
3.6 对于在2013年7月1日之前开始经批准的远洋服务，经认可的教育和培训项目或经认可培训课程的海员来说，所签发任何证书的有效期不应超过2017年1月1号，除非他们符合2010年马尼拉修正案的要求；
3.7 对于在2013年7月1日之后开始经批准的远洋服务，经认可的教育和培训项目或经认可培训课程的海员来说，签发的任何证书的有效期可以超过2017年1月1号。

1. The purpo of this circular is to inform about the adoption of Panama to the 2010 Manila
Amendments to the International Convention on Standards of Training, Certification and Watchkeeping for Seafarers (STCW), 78, as amended. This amendment will enter in force on January 1, 2012. This amendments was approved by Resolution ADM. No.148-2011 of November 18, 2011, promulgated in Official Gazette No. 26932-A of December 15, 2011.
2. The Panama Maritime Authority has adopted on Resolution JD 087-2010 the following certificates issued in accordance with the provisions of the 2010 Manila STCW 78 amendments:
2.1 Electro-Technical Officer (Reg. III/6)

2.3 Able Seafarer Deck (Reg. II/5)
2.4 Able Seafarer Engine (Reg. III/5)

3.1 Revalidation of certificates issued in accordance with the provisions of the Convention in force prior to 1 January 2012 and the issuance of certificates to afarers who commence approved agoing rvice, an approved education and training programme or an approved training cour before and after 1 July 2013;
3.2 Transitional provisions which do not relate to certification issues;
3.3 Security-related training provisions;
3.4 For afarers holding certificates issued in accordance with the provisions of the Convention which applied immediately prior to 1 January 2012 and who have not met the requirements of the 2010 Manila Amendments, the validity of any revalidated certificate should not extend beyond 1 January 2017; STCW.7/Circ.17.;
3.5 For afarers holding certificates issued in accordance with the provisions of the Convention which applied immediately prior to 1 January 2012 who have met the requirements of the 2010 Manila Amendments, the validity of any revalidated certificate can extend beyond 1 January 2017;
3.6 For afarers who commenced approved agoing rvice, an approved education and training programme or an approved training cour before 1 July 2013, the validity of any certificate issued should not extend beyond 1 January 2017, unless they meet the requirements of the 2010 Manila Amendments;

3.7 For afarers who commenced approved agoing rvice, an approved education and training
programme or an approved training cour after 1 July 2013 the validity of any certificate issued may extend beyond 1 January 2017.
