Cargo Exclusions
The vesl shall be employed in lawful merchandi excluding any goods of dangerous, injurious, flammable or corrosive nature regulated by IMO rules and BC Code. Without prejudice to the generality of the foregoing, following commodities are specifically excluded :
acids, ammunition, any kind of direct reduced iron and pellets, any kind of ed expellers, any kind of ed/oil ed, any type of pitch in bulk, ammonium nitrate, arms, ammunition and fire works, as listed by IMO regulation, asphalt, black powder and blast cap nitrates, bulk cotton eds, cotton, bone meal, borax, calcium/lead/ magnesium nitrate, calcium carbide, calcium chloride bagged and/or drummed, calcium, hydroxide, calcium hypo chloride or similar cargoes, canny ed, pet coke, caustic potash, caustic soda, cement in bulk, silicon mangane, copra, copra by products, creosoted goods, dangerous chemicals, dynamite, fish meal bagged or bulk, fluorspar, fissile materials, harmful dangerous or injurious cargo, ground nuts, gypsum, powder, HBI, hides, hypochlorite, in the form of nitrates sodium / ammonium / potassium / barium, injurious and/or dangerous and/or hazardous/inflammable/explosive cargoes, irradiated nuclear waste on fuel or hazardous waste, lined, livestock, logs, MBT always excluded, metal borings and cuttings, motor, naphtha, nitrate of soda, nuclear and/or radioactive materials, oily expeller, petroleum or its products, pond coal, quicklime,
radioactive waste products or its by products, rape eds, resin, Sulphur, resin in bulk, rice in bulk, rock, salt, sand expellers, scrap, shavings, spirits, slag, pet coke, concentrate, nickel ore, sodium chloride, spent oxide, sponge iron, tar, turpentine, TNT, war materials, zinc ashes, All dangerous, inflammable, injurious, hazardous and corrosive goods commodities as listed in the latest IMO D.G. and / or any subquent modification / amendments thereto.
Notwithstanding the above exclusions the following is agreed:
1) Salt protective clau
Charters have the option to carry total one (1) cargoes of salt and (whether it be full or part cargo) per each 12 months on following conditions:
(a) Charterers undertake to u holds as less as possible, provided vesl’s stability trim and stress permitting;角瓜
(b) Before loading all holds assigned for salt to be lime-washed by Charterers at their time/expen/risk to satisfaction of master which not to be unreasonably withheld.
(c) Cargo to be loaded/stowed/trimmed/discharged strictly according to latest IMO regulations.
(d) All fresh water ud for irrigation onto salt during loading /voyage /discharging to be Charterers’ account.
(e) After discharge Charterers to supply sufficient fresh water at their expen for washing down of all holds;
(f) Such cargo not to be the last cargo prior to redelivery;
(g) Any extra expens resulting therefrom/incurred thereby (such as hold cleaning to master’s satisfaction/hold survey etc.) and any detention through any of above caus to be for Charterers` account.
(h) Charterers are allowed to u ship’s crew to perform lime - washing and removal of same against paying USD 5,500 lumpsum besides normal intermediate hold cleaning, but always subject to local regulations permitting , and all time ud to be for Charterers` account. Owners/master are not held responsible for passing hold cleanliness for loading next cargo and for any conquences whatsoever caud due to such arrangement.The liberty granted to Charterers herein is subject to Charterers` guarantee that the above-mentioned salt will be not carried in concutive shipments / voyages. Owners have right to withdraw the liberty granted to Charterers herein in ca of any breac
h of above by Charterers.
It is understood that Owners / master agree not to apply any prior lime washing or alternative products in ca of loading 'chilean rock salt' with moisture content of about 0.02 percent as per usual recognized procedure of this trade.
2) Concentrate protective clau
Charters have the option to two (2) cargoes of any kind of concentrates (whether it be full or part cargo) per each 12 months on following conditions.
(a) Before commencement of loading Charterers/shippers to provide with laboratory analysis/certificate evidencing that both the flow moisture point and transportable moisture limit of such cargo are with in the limit as t out by IMO;
(b) Such cargo to be loaded/stowed/trimmed/discharged strictly

According to latest IMO and/or any other latest regulations/rules applicable to such cargo in the port(s)of loading;
(c) After loading Charterers undertake to arrange at their expen any special/extra trimming and/or levelling of cargo to satisfaction of master and independent surveyors appointed by Charterers/shippers at their expen;
(d) any extra expens resulting therefrom/incur red thereby (such as hold cleaning to master’s satisfaction/hold survey etc) and any detention through any of above caus to be for Charterers` account.
(e) Concentrates loaded at bourgas, bulgaria is allowed, but any extra cost other than loading such cargo at other port (s)/area to be for Charterers account.
3) Bulk cement protective clau
Charterers have the option to load two (2) cargoes of bulk cement (whether it be full or part cargo) per each 12 months on following conditions.
(a) Charterers und ertake to u holds as less as possible, provided vesl’s stability trim and stress permitting;
(b) Charterers have the option to cut holes in vesl’s hatch covers for loading bulk cement on follow
ing
conditions:
(1) All cutting and restoring of the hole s to be fully supervid / attended/ approved by vesl’s
classification surveyor with written documents.
(2) Holes not to be cut within the same frame space with the existing grain feeding holes and to be cut at the suitable place of hatch cover in accord ance with vesl’s builder’s specification. Welt protection to bilge well of all holds is strictly necessary to keep smooth suction while discharging hold washing water by using gum tapes (plaster) or so. When restoring cement holes , chill plates or similar material deemed necessary by master/’surveyor to be fitted for complete welding in order t o reinstate the hatch covers back to their original condition.
(3) After completion of restoring holes, Owners` option to have ho test carried out in prence with vesl’s classification surveyor and test result should be upto his satisfaction, otherwi Charterers have obligation to rectify the situation until and when satisfied by the vesl’s classification surveyors.
(4) All time for preparing cutting and re storing upto classification surveyor’s satisfaction as well as all expens including classification surveyor’s fees and expens shall be for Charterers` account but fees and expens for Charterers account.
(c) After loading Charterers undertake to arrange at their expen any special/extra trimming and /or levelling of cargo to master’s satisfaction
(d) Charterers are to wash all holds by fresh water immediately after complete of discharging and thoroughly remove residues and cement dust in holds at Char terers time and expens to master’s satisfaction. Bilge water not to be pumped through ship’s bilge lines but to be pumped overboard by submerge pump supplied by Charterers if same not on board. Crew to perform such cleaning if requested by Charterers and if permitted by local regulations, but Charterers still have to responsible for the removal of the dirty water after hold cleaning.炒鸡腿肉
(e) Such cargo not to be the last cargo prior to redelivery;
(f) Any extra expens resulting therefrom/incurred thereby and any detention through any of above caus to be for Charterers` account.
(g) Intermed hold cleaning USD 3500 lumpsum for bulk cement trading voyage besides normal holds cleaning.The liberty granted to Charterers herein is subject to Charterers` guarantee that the above-mentioned bulk cement will be not carried in concutive shipments/voyages. Owners have right to withdraw the liberty granted to Charterers herein in ca of any breach of above by Charterers.
4) Sulphur protective clau

(d) All fresh water ud for irrigation onto sulphur during loading /voyage /discharging to be Charterers`account.
(e) After discharge Charterers to supply sufficient fresh water at their expen for washing down of all holds;
(f) Such cargo not to be the last cargo prior to redelivery;
(g) Any extra expens resulting there from/incurred thereby (such as hold cleaning to master's satisfaction/hold survey etc.) And any detention through any of above caus to be for Charterers` account.
(h) Charterers are allowed to u ship's crew to perform lime-washing and removal of same against paying USD2,500 in lump sum besides normal intermediate hold cleaning, but always subject to local regulations permitting, and all time ud to be for Charterers' account. The liberty granted to Charterers herein is subject to Charterers' guarantee that the above-mentioned sulphur will be not carried in concutive shipments / voyages .Owners have right to withdraw the liberty granted to Charterers herein in ca of any breach of above by
Charterers.

ARRANGED BY AND PAID FOR BY THE CHARTERERS AND THE VESSEL TO REMAIN ON-HIRE. AFTER VESSEL HAS BEEN FUMIGATED AND REINSPECTED , THE SURVEYOR TO ISSUE AN AGM CERTIFICATE SHOWING VESSEL IS FREE OF ASIAN GYPSY MOTH. IN ANY CASE CHRTS GTEE THAT PRIOR VESSEL'S DEPARTURE FROM ANY AGM RISK PORTS OUT OF CHINA,S.KOREA AND JAPAN, THE VSL WILL BE PROVIDED WITH FREE AGM PHYTOSANITARY CERTIFICATE BY APPROVED SURVEYOR WHICH WILL REMAIN ON BOARD THE VSL.

BIMCO PIRACY CLAUSE APPLICABLE FOR THIS CP AS FOLL :
(a) The Vesl, unless the written connt of the Owners be first obtained, shall not be ordered to or required to continue to or through, any port, place, area or zone (whether of land or a),or any waterway or canal, where it appears that the Vesl, her cargo, crew or other persons on board the Vesl, in the reasonable judgement of the Master and/or the Owners, may be, or are likely to be, expod to any actual, threatened or reported acts of piracy,whether such risk of piracy existed at the time of entering into this charter party or occurred thereafter. Should the Vesl be within any such place as aforesaid, which only becomes dangerous, or is likely to be or to become dangerous, after her entry into it, she shall be at liberty to leave it.
地雷花图片(b) If the Owners do not give their connt they shall immediately inform the Charterers and the Charterers shall be obliged to issue alternative voyage orders and any time lost due to compliance with such orders shall not be considered off-hire.The Charterers shall indemnify the Owners for any claims from holders of Bills of Lading or third parties caud by such orders.
(c) If the Owners connt or if the Vesl proceeds to or through an area expod to risk of piracy the Owners shall have the liberty:
(i) to take reasonable preventive measures to protect the vesl, her crew and cargo including but n
ot limited to taking a reasonable alternative route, proceeding in convoy, using escorts, avoiding day or night navigation, adjusting speed or cour, or engaging curity personnel or equipment on or about the vesl,
(ii) to comply with the orders, directions or recommendations of any underwriters who have the authority to give the same under the terms of the insurance;
(iii) to comply with all orders, directions, recommendations or advice given by the Government of the Nation under who flag the Vesl sails, or other Government to who laws the Owners are subject, or any other Government,body or group, including military authorities, whatsoever acting with the power to compel compliance with their orders or directions;
(iv) to comply with the terms of any resolution of the Security Council of the United Nations, the effective orders of any other Supranational body which has the right to issue and give the same, and with national laws aimed at enforcing the same to which the Owners are subject, and to obey the orders and directions of tho who are charged with their enforcement; and the Charterers shall indemnify the Owners for any claims from holders of Bills of Lading or third parties caud by such orders.

(d) Costs

(i) If the Vesl proceeds to or through an area where due to risk of piracy additional costs will be incurred including but not limited to additional insurance inclusive of Kidnapping & Ransom Insurance and Piracy Loss of Hire, additional personnel and preventative measures to avoid piracy attacks, such costs shall be for the Charterers' account. Any time lost waiting for convoys, following recommended routing, timing, or reducing speed or taking measures to minimize risk, shall be for the Charterers' account and the Vesl shall remain on hire;
(ii) If the Owners become liable under the terms of employment to pay to the crew any bonus or additional wages in respect of sailing into an area which is dangerous in the manner defined by the said terms, then the actual bonus or additional wages (unstood it features usd 5000 lump sum for a single GOA transit) paid shall be reimburd to the Owners by the Charterers at the same time as the next payment of hire is due, or upon redelivery, whichever occurs first;
(iii) If the underwriters of the Owners' insurances should require payment of additional premiums and/or calls becau, pursuant to the Charterers' orders, the Vesl is within, or is due to enter and r
emain within, or pass through any area or areas which are specified by such Underwriters as being subject to additional premiums becau of piracy risks, then the actual additional premiums and/or calls paid shall be reimburd by the Charterers to the Owners at the same time as the next payment of hire is due, or upon redelivery, whichever occurs first.
(e) If the Vesl is attacked or ized by pirates any time lost shall be for the account of the Charterers and the Vesl shall remain on hire. If the Vesl is ized the Owners shall keep the Charterers cloly informed of the efforts made to have the Vesl relead.
(f) If in compliance with this Clau anything is done or not done,such shall not be deemed a deviation, but shall be considered as due fulfillment of this Charter Party.
