EMPLOYER’SLIABILITYINSURANCECLAUSES
Ⅰ.PARTIESTOBEINSURED
risincludingbutnotlimitedtoforeign-invested
enterpris,privateenterpris,domesticstockcompanies,
state-ownedenterpris,non-profitenterpris,collective
enterprisandcollectivelyorprivatelycontractedenterpris,
andalsopublicorganizations,governmentinstitutions,schools,
areallentitledtoapplyingtoChinaContinentProperty&
CasualtyInsuranceCompanyLimited(hereinafterreferredtoas
the"Insurer")toinsureagainsttheirlegalliabilitytotheir
employees(regularworkers,casuallabor,temporaryand
asonalworkersandapprenticesincluded)subjecttothe
termsandconditionsofthisPolicy.
resaidemployeesoftheInsuredrefertotho
whoarepaidforacertainoruncertainperiodofemployment
bytheInsuredandovertheageofsixteenortotho
approvedtobeemployedbystatutesandotherlegalmeans.
Ⅱ.COVERAGE
urerwillindemnifytheInsuredagainsthisliability
underthecontractofemploymentandatlawsandregulations
ofthePeople′sRepublicofChinatopaymedicalexpensand
othereconomiccompensationswithintheagreedlimitof

indemnityinrespectofdeathorbodilyinjuryordisablement
byaccidentorthroughoccupationaldia,tohimployee(s)
while,duringtheeffectiveperiodofthisinsuranceandinthe
courofemployment(includingtoandoffwork)bythe
Insured,beingengagedintheInsured′sbusinessasstatedin
thisPolicy.
TheInsurerwillalsoindemnifytheInsuredwithinthe
agreedsub-limitagainstdefencostspayablebytheInsured
totheclaimant,andotherlegalcostsandexpensincurred
withthewrittenconntoftheInsurer.
Withintheperiodofinsurance,themaximumamountof
indemnitybytheInsurerforallandeachitem(s)mentioned
hereinaboveshallinnocaexceedtheaggregatelimitof
indemnityasstatedinthePolicySchedule.
Ⅲ.EXCLUSIONS
urershallnotbeliablefor:
1)Death,dias,disabilityorbodilyinjurysustainedby
theInsured′mployee(s)namedintheScheduleinthe
courofemploymentbytheInsured,arisingfromwar,
militaryactions,strikes,riots,civilcommotionornuclear
radiation;
2)Bodilyinjuryand/ordisabilityto,ordeathofthe

employee(s)inthecourofemploymentbytheInsured,
caudbyorattributedtoillnessotherthanoccupational
dias,infectiousdias,childbirth,abortion,medical
treatmentandsurgicaloperationsnecessitatedbysuch
dias;
3)Bodilyinjuryand/ordisabilityto,ordeathofthe
employee(s)inthecourofemploymentbytheInsured,
caudbyorattributedtointentionallf-injury,suicideand
criminalact;
4)Bodilyinjuryand/ordisabilityto,ordeathofthe
employee(s)inthecourofemploymentbytheInsured,
caudbyorattributedtoalcoholordrugnotnecessitated
bytheaforesaidoccupation;
5)IntentionalactorgrossnegligenceoftheInsured;
6)TheInsured′sliabilitytoemployeesofcontractorsto
theInsured,unlessotherwistated;
7)Bodilyinjuryand/ordisabilityto,ordeathofthe
employee(s)inthecourofemploymentbytheInsured,
occurringoutsidetheterritoriallimitofthePeople’s
RepublicofChina,unlessotherwistated;
8)Otherlossandexpensnotincludedinthe
CoverageofthisPolicy.

Ⅳ.LIMITOFINDEMNITY
itofindemnityreferstotheagreedmaximum
amountofindemnitypayablebytheInsurertotheInsuredfor
lossordamagessustainedbytheInsured’mployee(s)in
respectofanyoccurrencewithintheCoverageofthisPolicy.
Ⅴ.PREMIUM
opriatepremiumratefortheInsuredshallbe
ascertainedbytheInsurerwithaviewoftheexposuresand
itofIndemnitymultipliedbytheRate
makestheduepremium.
Ⅵ.PERIODOFINSURANCE
uranceperiodofthisPolicyisoneyear,asfrom
0:00onthedayofinceptionto24:00onthedayofexpiration.
ThisPolicyshallberenewedontheexpirydate.
Ⅶ.TREATMENTOFCLAIM
dgingaclaimagainsttheInsurer,theInsured
shallprovidetheoriginalPolicy,therelevantProofofAccident,
MedicalReportissuedbymedicalorganization(s)recognized
bytheInsurer,Originalreceiptofmedicalexpensandany
othernecessaryandeffectivedocumentsrequiredbythe
urershallassoonaspossibleexamineallthe
documents,ttletheclaimandeffectpaymentwithin10days

fromthedatewhentheamountofindemnityismutually
agreedupon.
ventofoccurrencefallingwithintheCoverage
duringtheperiodofInsurance,theInsurershall,inthemanners
asfollows,indemnifytheInsuredagainsthisliabilityforthe
deathof,bodilyinjuryanddisablementtotheemployee(s),
specifiedintheNameListprovidedbytheInsured:
1)Inrespectofdeath,PermanentFull
Disablement/PermanentPartialDisablement:Thetotalamount
ofindemnityshallbecalculatedbymultiplyingthepercentage
tforthintheattachedIndemnityScaleofthePolicybythe
limitofindemnityfordeath,bodilyinjuryanddisablement
respectively.
2)InrespectofTemporaryDisabilityforaperiodexceeding
5days(thefirstfivedaysnotincluded):Duringthisperiod,as
certifiedbythehospital,theprofessionalinjurysubsidyper
personperdayshallbeinaccordancewiththeminimumliving
bsidy
shallbeterminatedoncethemedicaltreatmentiscompleted

3)InrespectofMedicalExpens:theInsurershallpaythe
expensforregistration,treatment,operation,sickbed,
examination(withalimitofRMB300Yuan),andmedicinesat

expensshallnotincludethofortending,food,nutrition,
transportation,heating,airconditioningandartificiallimb,
tooth,eyeandothersupportingutensilsfordisabledpersons.
Exceptinthecaofemergency,theinjuredemployeesshould
betreatedinthehospitalsatorabovethecountylevelor
appointedbythegovernmentortheInsurer.
Remarks:
TheamountofindemnitypayabletotheInsuredforeach
ofhimployeeundereachctionofArticle9hereinabove
shallnotexceedhisliabilityatlaworunderthecontractof
employment,andinnocaexceedanysub-limitofindemnity
foranyonepersonasindicatedintheScheduleofthisPolicy.

TheemployeesoftheInsuredshallnothave
compensationsbothfordeathandbodilyinjuryinrespectof
emnitylimitofmedicalexpen
paymentandthattodeathorbodilyinjurypaymentshallbe
appliedverally.

Insurershallonlybeliableforhisproportionoftheclaimfor
medicalexpens,injurysubsidy,andthedefencosts,no

numberindicatedintheScheduleofthePolicy,theInsurershall
onlybeliabletopaytheclaimsforlistedemployeesifthe
namesoftheemployeesinsuredarelistedinthePolicy,orto
paysuchproportionoftheclaimasthenumberofthe
employeesindicatedintheSchedulebearstotheactual
numberoftheemployees,unlessotherwiagreedbythe
Insurerifnecessary.

Ⅷ.OBLIGATIONSOFTHEINSURED

uredandhisreprentative(s)shallgivetrueand
detailedanswersand/ordescriptionstothequestionsinthe
ProposalandQuestionnaireortoanyotherquestionraidby
theInsurer.
uredshallpaytotheInsurerinduecourthe
agreedpremiuminthemannerasspecifiedintheScheduleof
thePolicy.
uredshalltakeallreasonableprecautionsto
preventaccidentbystrengtheningsafetymanagementand
complyingwithallstatutoryregulationsandsafetyoperation
ventofanyoccurrenceofaccident,the
Insuredshalltakeallnecessaryandreasonablemeasuresto
minimizetheloss.
uredshallnotifytheInsurerinwritingwithinfive
(5)daysiftherehasanymaterialchangeofthesubjectinsured
intheProposaland/ortheScheduleofthePolicy,andthe
premiumwouldbereadjustedbytheInsureraccordingly.
Otherwi,theInsurershallnotbeliableforanyclaimresulting
therefrom.

1)NotifytheInsurerimmediatelyandwithinven(7)days
oranyfurtherperiodasmaybeagreedbytheInsurerinwriting,
furnishawrittenreporttoindicatethecourandprobable
reasonoftheaccident,theextentoflossordamage,andassist
theInsurerininvestigatingtheaccident;2)Makeno
admission,offer,promi,orexpressofpaymentwithoutprior
i,theInsurerwillnotbeliable;
3)GiveimmediatenoticeinwritingtotheInsurerwhenever
havingknowledgeofanyimpendingprocutioninconnection
withanyaccidentforwhichtheremaybeliabilityunderthis
Policyagainsthim,andforwardtotheInsurereveryletter,writ,
summonorprocessorotherlegaldocumentsonreceipt
urershallbeentitledtolodgingalawsuitor
pursuerecoveryinthenameofandonbehalfoftheInsured,
andtheInsuredshallmakeeveryefforttorenderallnecessary
assistance.

athisdiscretion,eithertorepudiatinganyliabilityunderthe
PolicyortocancelingthisPolicybywrittennotice.
Ⅸ.GENERALCONDITIONS

Effect
Thedueobrvanceandfulfillmentofthetermsand
conditionsofthisPolicyinsofarastheyrelatetoanythingto
bedoneorcompliedwithbytheInsuredshallbeacondition
precedenttoanyliabilityoftheInsurerunderthisPolicy.
Termination
ThisPolicyshallbeautomaticallyterminatedifthe
erminationofthe
Policy,thepremiumshallberefundedtotheInsuredcalculated
onproratadailybasisfortheperiodfromthedateof
terminationtothedateofexpiry.
Cancellation
ThisPolicymaybecancelledatanytimeattherequestof
theInsuredinwritingorattheoptionoftheInsurerbygivinga
fifteen(15)ormerca
theInsurershallretainapremiumcalculatedonshort-termrate
basisforthetimethePolicyhasbeeninforcewhileinthelatter
casuchpremiumshallbecalculatedonproratadailybasis.

Iftheclaimisinanyrespectfraudulent,orifanyfraudulent
meansordevicesareudbytheInsuredorhisreprentative
toobtainanybenefitunderthisPolicyorifanylossordamage

isoccasionedbytheintentionalactorintheconnivanceofthe
Insuredorhisreprentative,theninanyofthecas,allthe
rightsandbenefitsoftheInsuredunderthisPolicyshallbe
forfeited,andallconquentlossarisingtherefromincluding
theamountofclaimpaidbytheInsurershallbeindemnifiedby
theInsured.

Whereathirdpartyshallbeheldresponsibleforthelossor
damagecoveredunderthisPolicy,theInsuredshall,whether
beingindemnifiedbytheInsurerornot,takeallnecessary
measurestoenforceorrervetherightofrecoveryagainst
suchthirdparty,anduponbeingindemnifiedbytheInsurer,
subrogatetotheInsureralltherightofrecovery,transferall
necessarydocumentstoandassisttheInsurerinpursuing
recoveryfromtheresponsibleparty.

Regardingthedisputearisingoutofthisinsurance,the
contractingpartiesareobligedtochooandspecifyinthe
contractoneofthefollowingtwodisputettlementmeans:
1)ShouldanydisputeariunderthisPolicy,the
contractingpartiesshallttlethedisputethroughnegotiation.
Incanoagreementisreached,suchdisputeshouldbe

submittedto
arbitrationcommitteeforarbitration.
2)ShouldanydisputeariunderthisPolicy,the
contractingpartiesshallttlethedisputethroughnegotiation.
Incanoagreementisreached,eitherpartymayfilealawsuit
onthePeople’sCourt.
