TheMinisterofLabourintendsto,intermsofction43oftheOccupationalHealth

andSafetyAct,1993ontherecommendationoftheAdvisoryCouncilfor

OccupationalHealthandSafetytorepealtheElectricalInstallationRegulations,

1992andsuperdeitbywordinginaccordancewiththeschedule.

Interestedpersonsareinvitedtosubmitanysubstantiatedcommentsor

prentationsonthepropodregulationstotheDirectorGeneralofLabour,Private

BagX117,Pretoria,0001(fortheattentionofthechiefinspector:Occupational

HealthandSafety),within90daysofthedateofpublicationofthisnotice.

SCHEDULE

ELECTRICALINSTALLATIONREGULATIONS

Definitions

eregulationsanyawordorexpressiontowhichameaninghas

beenassignedintheActshallhavethemeaningsoassignedand,unlessthe

contentotherwiindicates

“accreditationauthority”meanstheSouthAfricanNationalAccreditationSystem

(SANAS);

“annexure”meansanannexuretotheregulations;

“approvedinspectionauthorityforelectricalinstallations”meansapersonor

bodyapprovedbythechiefinspectorintermsofregulation5tocarryout

inspections,testsandinvestigationsofelectricalinstallations;

“electricalcertificateofcompliance”meansacertificate,withauniquenumber

obtainablefromthechiefinspector,intheformofannexure4,andissuedbya

registeredpersoninrespectofanelectricalinstallationorpartofanelectrical

installationoracertificateofcomplianceissuedundertheElectricalInstallation

Regulations,1992;

“electricalcontractor”meansaperson,whoundertakestoperformelectrical

installationworkonbehalfofanyotherperson,butexcludesanemployeeofsuch

firstmentionedperson;

“electricalinstallation”meansanymachinery,inoronanypremis,udforthe

transmissionofelectricityfromapointofcontroltoapointofconsumptionanywhere

onthepremis,includinganyarticleformingpartofsuchaninstallation

irrespectiveofwhetherornotitispartoftheelectricalcircuit,butexcluding

(a)anymachineryofthesupplierrelatedtothesupplyofelectricityon

thepremis;

(b)anymachinerywhichtransmitlectricalenergyincommunication,

televisionorradiocircuits;

(c)anelectricalinstallationonavehicle,vesl,trainoraircraft.

“electricaltesterforsinglepha”meansapersonwhohasbeenregisteredas

anelectricaltesterforsinglephaintermsofregulation13andwhohasbeen

approvedbythechiefinspectorfortheverificationandcertificationofthe

construction,testingandinspectionofelectricalinstallationssuppliedbyasingle

phaelectricitysupply,excludingspecializedelectricalinstallations;

“generalcontrol”includestheinstruction,guidanceandsupervisionofregistered

personoverelectricalinstallationworkthatisbeingcarriedout;

“installationelectrician”meansapersonregisteredasaninstallationelectricianin

termsofregulation13whohasbeenapprovedbythechiefinspectorforthe

verificationandcertificationoftheconstruction,testingandinspectionofany

electricalinstallation,excludingspecializedelectricalinstallations.

“installationwork”meanstheinstallation,extension,modification,repairof,orthe

inspection,testingandverificationofelectricalinstallations,includingtheconnection

ofmachineryatthesupplyterminalsofsuchmachinery;

“masterinstallationelectrician”meansapersonwhohasbeenregisteredasa

masterinstallationelectricianintermsofregulation13andwhohasbeenapproved

bythechiefinspectorfortheverificationandcertificationoftheconstruction,testing

andinspectionofanyelectricalinstallation;

“nationaldataba”meansadatabaudforthecapturingofallinformation

necessaryintermsoftheregulations;

“pointofconsumption”meansanypointofoutletorthesupplyterminalsof

machinerywhichisnotconnectedtoapointofoutletandwhichconvertlectrical

energytoanotherformofenergy:Providedthatinthecaofmachinerywhichhas

beeninstalledforanyspecificpurpoasacompleteunit,thepointofconsumption

shallbethesupplyterminalswhichhavebeenprovidedontheunitofmachineryfor

thatpurpo;

“pointofcontrol”meansthepointatwhichtheelectricalinstallationonorinany

premiscanbeswitchedoffbyaurorlessorfromtheelectricitysuppliedfrom

thepointofsupply,orthepointatwhichpartoftheinstallationonthepremis

canbeswitchedoffwheredifferentursoccupydifferentpartsofsuchpremis;

“pointofoutlet”meansanyterminationofanelectricalinstallationwhichhasbeen

providedforconnectinganyelectricalmachinerywithouttheuoftools;

“pointofsupply”meansthepointatwhichelectricityissuppliedtoanypremis

byasupplier;

“provincialdirector”meanstheprovincialdirectorasdefinedinregulation1ofthe

GeneralAdministrativeRegulationspublishedunderGovernmentNoticeNo.R.

1449of6September1996;

“reasonablypracticablesafeelectricalinstallation”inrelationtoanelectrical

installationthatexistedpriortothepublicationofthecurrenteditionofthehealth

andsafetystandardincorporatedintotheregulationsintermsofregulation7(1)

meansthatsuchelectricalinstallationcomplieswiththegeneralsafetyprinciplesof

suchstandard;

“registeredperson”meansapersonregisteredintermsofregulation13asan

electricaltesterforsinglepha,aninstallationelectricianoramasterinstallation

electrician,asthecamaybe;

“SANS1086-1”meansthecodeofpracticefortheinstallationandmaintenanceof

electricalequipmentudinexplosiveatmospherespublishedbyStandardsSouth

Africa;

“SANS1089-2”meanstheelectricalcodeofpracticeforthepetroleumindustry

publishedbyStandardsSouthAfrica;

“SANS10180”meansthecodeofpracticefortheclassificationofhazardous

locationsandthelectionofelectricalapparatusforuinsuchlocations

publishedbyStandardsSouthAfrica;

“SANS10142-1”meanstheCodeofpracticeforthewiringofpremispublishedby

StandardsSouthAfrica;

“specializedelectricalinstallations”meanlectricalinstallationsin

(a)explosiveatmospheresascontemplatedinSANS1086-1;

(b)thepetroleumindustryascontemplatedinSANS1089-2;

(c)hazardouslocationsascontemplatedinSANS10108;

(d)medicallocationsascontemplatedinSANS10142-1;

“supplier”inrelationtoaparticularelectricalinstallation,meansanybodyor

personwhosuppliesorcontractsoragreestosupplyelectricitytothatelectrical

installation;

“supplyterminals”inrelationtomachineryinstalledasacompleteunit,means

theterminalsorconnectionclampsonsuchmachinerywheretheexternal

conductorssupplyingthemachinerywithelectricityareterminatedorconnected;

“technicalworkinggroup”meansatechnicalworkinggroupestablishedinterms

ofregulation3;

“validcertificatecompliance”meansanelectricalcertificateofcompliancewhich

hasbeenissuedinaccordancewiththeregulationsandhasbeencorrectly

completedinitntiretybyaregisteredperson.

Scopeofapplication

2(1)Theregulationsshallbeapplicabletoursorlessors,approved

inspectionauthoritiesforelectricalinstallations,registeredpersons,electrical

contractors,suppliers,designersandtosuppliersofmaterialsandotherelectrical

articlesorpartsthereofwhethertemporary,permanent,orinastationaryormobile

stateandinstallation.

EstablishmentoftechnicalworkinggroupforElectricalInstallation

Regulations

3(1)Thechiefinspectormayestablishoneormoretechnicalworking

groupstoadvithehimorheronanymatterrelatingtotheRegulations.

(2)Amemberofatechnicalworkinggroupshallbeappointedbythechief

inspectorbyreasonofhisorherknowledgeofthematterforwhichthetechnical

workinggroupistablished.

(3)Amemberofatechnicalworkinggroupwhoisnotanofficermaybe

remuneratedfrommoneyappropriateforsuchpurpobytheMinister.

(4)Thechiefinspectorshallappointthetechnicalworkinggroupmembers

forsuchperiodasheorshemaydetermineatthetimeofappointment:Provided

thatthechiefinspectormaydischargeamemberatanytime,forreasonsthatare

fairandjust,andappointanewmemberinhisherorherplace.

(5)Thechiefinspectormayco-optanypersonorpersonswhohave

specializedknowledgeofanymatterdealtwithbyatechnicalworkinggroup.

(6)Atechnicalworkinggroupshallconductitsworkinaccordancewith

theinstructionsandrulesofconducttbythechiefinspector.

Responsibilityforelectricalinstallations

4(1)Theurorthelessoroftheelectricalinstallation,asthecamaybe,

shallberesponsibleforthesafety,safeuandmaintenanceoftheelectrical

installationheorsheusorleasand,exceptforworkaspermittedinregulation

11(3),shallnottamperwithorallowanytamperingonanyinstallationwhetheror

notacertificateofcompliancehasbeenissued.

(2)Theurorlessoroftheelectricalinstallation,asthecamaybe,

shallberesponsibleforthesafetyoftheconductorsonhisorherpremis

connectingtheelectricalinstallationtothepointofsupplyinthecawherethe

pointofsupplyisnotthepointofcontrol.

(3)Wherethereisnowrittenundertakingbythelesetoensure

complianceandthesafetyoftheelectricalinstallationheorshetheleas,the

owneroftheelectricalinstallationshallbedeemedtobetheurofsuchelectrical

installation.

Approvedinspectionauthoritiesforelectricalinstallations

5(1)Thechiefinspectormayapproveanyjuristicpersonorbodythathave

beenaccreditedbytheaccreditationauthority,asanapprovedinspectionauthority

forelectricalinstallations.

(2)(a)Applicationforapprovalofanapprovedinspectionauthority

contemplatedinsub-regulation(1)shallbemadetothechiefinspectorintheformof

annexure7;

(b)Avalidaccreditationissuedbytheaccreditationauthorityshall

accompanytheapplication;and

(c)Theapplicationformshallbeaccompaniedbythefeedeterminedin

termsofregulation15.

(3)AnApprovedInspectionAuthorityforelectricalinstallationsshall

informthechiefinspectorofanychangesaffectingitsapprovalintermsofsub-

regulation(1)within14daysaftersuchchanges.

(4)Thechiefinspectormayatanytimewithdrawanyapprovalofan

approvedinspectionauthorityforelectricalinstallations,subjecttotheprovisionsof

ction35oftheActandregulation13(5).

Functionsofapprovedinspectionauthoritiesforelectricalinstallations

6(1)Approvedinspectionauthoritiesforelectricalinstallationsshallonly

enterpremisandconductaninspection,testorinvestigationwhen:

(a)instructedtodosobythechiefinspectororprovincialdirector;or

(b)requestedtodosobytheownerorurofanelectricalinstallation.

(2)Approvedinspectionauthoritiesforelectricalinstallationsshallnot

operatealectricalcontractors.

(3)Approvedinspectionauthoritiesforelectricalinstallationsshallonly

inspectthetypesofinstallationforwhichtheyhavebeenaccreditedbythe

accreditationauthority.

(4)Approvedinspectionauthoritiesforelectricalinstallationsshallbe

accountableandabidebyacodeofethicsdeterminedbythechiefinspector.

(5)Approvedinspectionauthoritiesforelectricalinstallationsshall

submit

reportstothepersonreferredtoin1(a)or1(b)respectively.

Designandconstruction

7(1)Nopersonshallauthorize,design,installorpermitorrequirethe

installationofanelectricalinstallation,otherthaninaccordancewithahealthand

safetystandardincorporatedintotheregulationsunderction44oftheAct:

Providedthatthecomponentswithinanelectricalinstallationshallcomplywiththe

standardsreferredtointheincorporatedstandardandproofofcomplianceshallbe

identifiableonthecomponentsorcertificationshallbeavailablefromthesupplieror

manufacturerofthecomponents:Providedfurtherthatitemsofanelectrical

installationnotcoveredbysuchincorporatedsafetystandard,andtheconductors

betweenthepointofsupplyandthepointofcontrol,shallbeinstalledinaccordance

withtheby-lawsorregulationsofthesupplierconcerned.

(2)Aregisteredpersonshallexercigeneralcontroloverallelectrical

installationworkbeingcarriedout,andnopersonshallallowsuchworkwithoutsuch

control:Providedthatwherethevoltageexceeds1kV,theinstallationshallbe

designedandsupervidbyapersondeemedcompetentintermsofparagraphs(b),

(c)or(d)ofthedefinitionofacompetentpersoninregulation1oftheGeneral

machineryRegulations,1998.

(3)Nosuppliershallrestricttheapplicationofahealthandsafety

standardreferredtoinsub-regulation(1)whenanelectricalinstallationisinstalled,

exceptwherethedistributionsystemofthesuppliermaybeadverlyaffectedby

theapplicationthereof.

Electricalcontractor

8(1)(a)Anyperson,includingajuristicperson,whointendstodoinstallation

workasanelectricalcontractorshallregisterannuallywiththechiefinspectorinthe

formprescribedinannexure1.

(b)Theapplicationshallbeaccompaniedbythefeedeterminedinterms

ofregulation15.

(2)Thechiefinspectorshallregisteranypersoncontemplatedinsub-

regulation1asanelectricalcontractorandentersuchregistrationintothenational

databa:Providedsuchperson:

(a)hasafixedaddressandatelephoneormobiletelephonelistedinthe

nameofthebusiness:Providedthatifthepersondoesnottradeunderthenameof

abusiness,suchaddressandtelephonemaybeinthenameoftheperson

concerned;and

(b)employsaregisteredpersononafulltimebasis,orishimlfor

herlfaregisteredpersonengagedinsuchbusinessonafulltimebasis.

(3)(a)Aregisteredpersonwhointendstodospecificelectricalinstallation

workonbehalfofanotherpersonshallregisterwiththechiefinspectorasa

temporaryelectricalcontractorintheformprescribedinannexure2.

(b)Theapplicationformshallbeaccompaniedbythefeedeterminedin

termsofregulation15.

(4)Thechiefinspectormayatanytimewithdrawtheregistrationofany

electricalcontractorortemporaryelectricalcontractor,subjecttotheprovisionsof

ction35oftheAct.

Certificateofcompliance

9(1)Subjecttotheprovisionsofsub-regulation(3)everyurorlessorof

anelectricalinstallation,asthecamaybe,shallhaveanoriginalvalidcertificate

ofcomplianceintheformofannexure4,whichshallbeaccompaniedbyatest

reportintheformatapprovedbythechiefinspector,inrespectofeverysuch

installation:Providedthatsuchcertificateistransferable:Providedfurtherthata

certificateolderthantwoyearsisnottransferable.

(2)Everyurorlessorofanelectricalinstallation,asthecamaybe,

shallonrequestproducethecertificateofcomplianceforthatinstallationtoan

inspector,anapprovedinspectionauthorityforelectricalinstallationssubjectto

regulations6(1),orthesupplier.

(3)Sub-regulation(1)shallnotapplytoanelectricalinstallationthat

existedpriorto23October1992andwheretherewasnochangeofownership

before1March1994:Providedthatwhen

(a)anyadditionoralterationiffectedtosuchinstallation;or

(b)thereisasubquentchangeofownershipofthepremisonwhich

suchinstallationexistsandwherenocertificateofcompliancehasbeenissued.

(4)Whereanyadditionoralterationhasbeeneffectedtoanelectrical

installationforwhichacertificateofcompliancewaspreviouslyissued,theuror

lessorofsuchinstallationshallobtainacertificateforatleasttheadditionor

alteration.

(5)Asuppliermayatanyreasonabletimeinspectortestanyelectrical

installation:Providedthatthesuppliershallnotchargeanyfeeforsuchan

inspectionortestunlesstheinspectionortestiscarriedoutattherequestof

theurorlessor.

(6)Ifafteraninspector,anapprovedinspectionauthorityforelectrical

installationsorsupplierhascarriedoutaninspectionortestandhasdetectedany

faultordefectinanyelectricalinstallation,suchinspector,approvedinspection

authorityforelectricalinstallationsorsuppliermayrequiretheurorlessorofthat

installationtoobtainanewcertificateofcompliance:Providedthatifsuchfaultor

defectintheopinionoftheinspector,approvedinspectionauthorityforelectrical

installationsorsupplierconstitutesanimmediatedangertopersons,theinspector,

approvedinspectionauthorityforelectricalinstallationsorsuppliershallforthwith

takestepstohavethesupplytothecircuitinwhichthefaultordefectwas

detecteddisconnected:Providedfurtherthatwheresuchfaultordefectisofsucha

naturethatitmayindicatenegligenceonthepartofaregisteredperson,the

inspector,approvedinspectionauthorityforelectricalinstallations,orsupplier,as

thecamaybe,shallforthwithreportthocircumstancesinwritingtothechief

inspector.

(7)Subjecttotheprovisionsofction22oftheAct,nopersonshallll

thepremisonwhichanelectricalinstallationexists,withoutavalidcertificateof

compliancefortheelectricalinstallation:Providedthatawrittenagreementmaybe

enteredintobetweenthepartiesastoobtainingacertificateofcompliance.

(8)Aregisteredpersonshallonlyissueacertificateofcompliance

obtainablefromthechiefinspectorandwithauniquenumberissuedbythechief

inspector.

Commencementandpermissiontoconnectinstallationwork

10(1)Nopersonshallcommencewithinstallationworkwhichwouldrequire

anewsupplyoranincreainelectricitysupplycapacityunlessthesupplierhas

beennotifiedthereofintheformofAnnexure3:Providedthatthesuppliermay

waivethisrequirementinrespectofsuchtypesofworkasitmayspecify.

(2)Nopersonshallconnectorpermittheconnectionofanycompletedor

partiallycompletedelectricalinstallationtotheelectricitysupplyunlessithasbeen

inspectedandtestedbyaregisteredpersonandacertificateofcomplianceforthat

electricalinstallationhasbeenissued:Providedthatthesuppliermayonrequest

connectthesupplytotheinstallationforthepurpooftestingandcompletionofthe

certificateofcompliancebyaregisteredperson:Providedfurtherthatthissub-

regulationshallnotapplyinthecawheretheelectricitywasdisconnectedforthe

non-paymentoftheelectricityaccountorwheretherehasbeenachangeoftenant

butnotofownership.

(3)Wherethesupplytoanelectricalinstallationis25kVAorabove,the

urshallsubjecttoregulation11(1),appointanapprovedinspectionauthorityora

competentpersoncompletedinregulation7(2)whoshallensurethecompliance

fromthecommencementtothecommissioningoftheinstallation.

Issuingofcertificateofcompliance

11(1)Onlyregisteredpersonmayissueacertificateofcomplianceinthe

formofannexure4andwhichshallbeaccompaniedbyatestreportintheformat

approvedbythechiefinspector,afterhavingsatisfiedhimlforherlfbymeansof

aninspectionandtestingthat

(a)anewelectricalinstallationcomplieswiththeprovisionsofregulation7

(1);or

(b)anelectricalinstallationwhichexistedpriortothepublicationofthe

currenteditionofthehealthandsafetystandardincorporatedintotheregulations

intermsofregulation7(1),complieswiththegeneralsafetyprinciplesofsuch

standard;or

(c)anelectricalinstallationwhichexistedpriorthepublicationofthe

currenteditionofthehealthandsafetystandardincorporatedintotheregulations

intermsofregulation7(1)andtowhichextensionsoralterationshavebeen

affected,that─

(i)tingpartoftheinstallation,complieswiththegeneralsafetyprinciples

ofsuchstandardandisreasonablesafe,and

(ii)extensionsoralterationsaffectedcomplywiththeprovisionsof

regulation7(1).

(2)Ifatanytimepriortoissuingacertificateofcomplianceanyfaultor

defectisdetectedinanypartoftheinstallation,theregisteredpersonshallrefuto

issuesuchcertificate:Providedthatifsuchfaultordefectintheopinionofthe

registeredpersonconstitutesanimmediatedangertopersonsinthecawhere

electricityisalreadysupplied,heorsheshallforthwithtakestepstodisconnectthe

supplytothecircuitinwhichthefaultordefectwasdetectedandnotifythechief

inspector.

(3)Anypersonwhoundertakestodoelectricalinstallationworkshall

ensurethatavalidcertificateofcomplianceisissuedforthatwork.

(4)Nopersonshallamendacertificateofcomplianceissuedbya

registeredperson.

Appeals

12(1)Shouldadisputeariovertheinterpretationofahealthandsafety

standardreferredtoinregulation7betweentheur,theregisteredperson,the

approvedinspectionauthorityforelectricalinstallations,orthesupplier,astheca

maybe,theaffectedpersonmayappealagainstthatinterpretationtothechief

inspector.

(2)Thepersonwhoappealsundersub-regulation(1)shallrveanotice

ofappeal,ttingoutfullythegroundsoftheappeal,onboththechiefinspectorand

thepersonagainstwhointerpretationheorsheisappealing,bypersonally

deliveringthenoticeofappealorndingitbyregisteredpost.

(3)Thepersonagainstwhointerpretationisbeingappealedshall,

within14workingdaysofthedateofonwhichheorshereceivedthenoticeof

appeal,forwardanoticettingoutthereasonsforhisorherinterpretation,tothe

chiefinspector.

(4)Thechiefinspectorshall,afterhavingconsideredthegroundsofthe

appealandthecauofthedispute,confirm,tasideorvarytheinterpretationof

thesafetystandardreferredtoinsub-regulation(1)orsubstituteitforsuch

interpretation,whichintheopinionofthechiefinspectoroughttohavebeentaken.

Applicationforregistrationasaregisteredperson

13(1)(a)Applicationforregistrationasaregisteredpersonshallbemadetothe

chiefinspectorintheformprescribedinAnnexure5.

(b)Theapplicationshallbeaccompaniedbythefeedeterminedinterms

ofregulation15.

(2)Anynaturalpersonwhosatisfiesthechiefinspectorthatheorshe

(a)hassufficientknowledgeoftherulesapplicabletoelectrical

installationsinthecategoryforwhichapplicationisbeingmade;

(b)hasappropriatepracticalexperienceinrespectoftheinstallation,

verificationandcertificationoftheconstruction,testingandinspectionofthetypeof

electricalinstallationforwhichapplicationisbeingmade;

(j)meetsanyotherrequirementsasmaybeprescribedbythechief

inspector;

shallatthediscretionofthechiefinspectorberegisteredasanelectricaltesterfor

singlepha,aninstallationelectrician,oramasterinstallationelectrician,asthe

camaybe.

(3)Thechiefinspectorshallfurnishsuchpersonwiththeappropriate

certificateofregistration,subjecttosuchconditionsorrestrictions,asheorshemay

deemnecessaryandentersuchregistrationintothenationaldataba.

(4)Aregisteredpersonshallonrequestproducehisorhercertificateof

registrationtoaninspector,approvedinspectionauthorityforelectricalinstallations,

thesupplieroranypersontowhomheorsheintendstoissueacertificateof

compliance.

(5)Ifintheopinionofthechiefinspectorapersonwhoistheholderofa

certificatesofregistrationissuedintermsofsub-regulations(2)orreferredtoin

regulations17(2)hasbeenfoundguiltyofgrossnegligenceintheexecutionofhis

orherduties,orisnolongerdeemedcompetenttoperformhisorherduties,the

chiefinspectormaysuspendorcancelsuchcertificateofregistration.

(6)Aregisteredpersonshallinformthechiefinspectorofanychanges

affectinghisorherregistrationwithin14daysaftersuchchange.

Substitutionoflost,damagedordestroyedcertificateofregistration

14(1)(a)Ifaregistrationcertificateissuedintermsofregulation8(2),8(3)(a),

13(3)orreferredtoinregulation17(2)hasbeenlost,damagedordestroyed,the

registeredpersontowhomthecertificatewasissued,mayapplytothechief

inspectorforaduplicatecertificateintheformofannexure6.

(b)Theapplicationshallbeaccompaniedbythefeedeterminedinterms

ofregulation15.

(2)Afterproofthatacertificateofregistrationhasbeenlost,damagedor

destroyedhasbeensubmittedtothesatisfactionofthechiefinspector,thechief

inspectorshallissueasubstitutethereofonwhichtheword“duplicate”willappear.

Feespayable

15(1)TheMinistershalldetermineallregistrationandrelatedfeeswhich

shallbepayableintheformofuncancelledrevenuestampsaffixedtotherelevant

applicationform.

Offencesandpenalties

16(1)Anypersonwhocontravenesorfailstocomplywiththeprovisionof

regulations4,6,7,8,9,10,11,13(4)and13(6)shallbeguiltyofanoffenceandbe

liableonconvictiontoafineortoimprisonmentformaximumof12monthsand,in
