CHAPTERIIMARRIAGECOTRACTS

(1)ifthemanandthewomanarelinealrelativesbyblood,orcollateralrelativesbyblooduptothe

thirddegreeofkinship;or

(2)ifthemanorthewomanissufferingfromleprosy,acurenothavingbeeneffected,orfromany

otherdiseasewhichisregardedbymedicalscienceasrendingapersonunfitformarriage.

CHAPTERIVDIVORCE

riageregistrationoffice,afterclearlyestablishingthat

divorceisdesiredbybothpartiesandthatappropriatearrangementshavebeenmadeforthecareofany

childrenandthedispositionofproperty,shallissuethedivorcecertificateswithoutdelay.

artyalonedesiresadivorce,theorganizationconcernedmaycarryoutmediationor

thepartymayappealdirectlytoapeople'scourttostartdivorceproceedings.

Indealingwithadivorcecase,thepeople'scourtshouldcarryoutmediation;divorceshallbegranted

ifmediationfailsbecausemutualaffectionnolongerexists.

pouseofasoldierinactiveservicedesiresadivorce,thesoldier'sconsentmustbe

obtained.

ndmaynotapplyforadivorcewhenhiswifeispregnantorwithinoneyearafterthe

strictionshallnotapplyincaseswherethewifeappliesforadivorce,orwhen

thepeople'scourtdeemsitnecessarytoacceptthedivorceapplicationmadebythehusband.

Afterdivorce,bothparentsshallstillhavetherightanddutytobringupandeducatetheirchildren.

Inprinciple,putearises

betweenthetwoparentsoverthecustodyoftheirchildwhohasbeenweanedandtheyfailtoreachan

agreement,thepeople'scourtshallmakeajudgmentinaccordancewiththerightsandinterestsofthe

childandtheactualconditionsofbothparents.

,afterdivorce,oneparenthasbeengivencustodyofachild,theotherparentshallbearpart

orthewholeofthechild'parentsshallseek

failtoreachanagreement,the

people'scourtshallmakeajudgment.

Theagreementorcourtjudgmentonthepaymentofachild'slivingandeducationalexpensesshall

notpreventthechildfrommakingareasonablerequest,whennecessary,toeitherparentforanamount

exceedingwhatwasdecideduponinthesaidagreementorjudgment.

failtoreachanagreement,thepeople'scourtshall

makeajudgment,takingintoconsiderationtheactualcircumstancesofthepropertyandtherightsand

interestsofthewifeandthechild.

imeofdivorce,debtsincurredjointlybythehusbandandthewifeduringtheir

propertyisinsufficienttopay

thedebts,failtoreachanagreement,

thepeople'ncurredseparatelybythehusbandorthewifeshallbe

paidbythepartywhoincurredthem.

,atthetimeofdivorce,onepartyhasdifficultyinsupportinghimselforherself,theother

icarrangementsshallbeworkedoutbyboth

failtoreachanagreement,thepeople'scourtshallmakeajudgment.

CHAPTERVSUPPLEMETARYPROVISIOS

sviolatingthisLawshallbesubjecttoadministrativeorlegalsanctionsinaccordance

withthelawandonthemeritsofeachcase.

maintenanceorsupportpayments,oronthepartitioningorinheritanceofproperty,thepeople'scourt

concernedshallhavethedutytoassistsuchexecutions.

formulatecertainadaptationsorsupplementaryprovisionsinkeepingwiththeprinciplesofthisLawand

inthelightofthespecificconditionsofthelocalnationalitiesinregardtomarriageandfamily.

Provisionsformulatedbyautonomousprefecturesandautonomouscountiesmustbesubmittedtothe

standingcommitteeofthepeople'scongressoftherelevantprovinceorautonomousregionforapproval.

ProvisionsformulatedbyautonomousregionsmustbesubmittedtotheStandingCommitteeofthe

ationalPeople'sCongressfortherecord.

wshallcomeintoforceasofJanuary1,1981.

TheMarriageLawofthePeople'sRepublicofChinapromulgatedonMay1,1950shallbe

invalidatedasofthedaythisLawcomesintoforce.
